Viven AG, Zeughausstrasse 31, 8004 Zürich, Switzerland ("Viven", "we", "us") operates the website www.viven.ch and is the controller responsible for the data processing described in this privacy policy. This policy explains what personal data we collect, why we collect it, and how we handle it.

2. Applicable law

We process personal data in accordance with the Swiss Federal Act on Data Protection (FADP/nDSG). Where the EU General Data Protection Regulation (GDPR) applies — for example, when we offer services to persons in the EU/EEA or monitor their behaviour — we also comply with its requirements. Switzerland's level of data protection is recognised by the European Commission as adequate.

We process personal data on the following legal bases:

  • Your consent (e.g. analytics cookies, newsletter), which you may withdraw at any time;
  • Performance of a contract or pre-contractual measures (e.g. responding to project enquiries, producing films);
  • Compliance with legal obligations (e.g. accounting and retention duties);
  • Our legitimate interests, such as the secure operation of our website, business administration, and marketing of our services.

4. Server log files

When you visit our website, our hosting provider automatically collects technical data: IP address, date and time of access, browser type and version, operating system, referrer URL and pages viewed. This data is needed to deliver the website reliably and securely, to detect misuse and to diagnose technical problems. Log data is regularly deleted and is not merged with other data sources.

5. Cookies & consent

Our website uses cookies and similar technologies. Strictly necessary items — such as your language choice and your cookie preference, which we store locally in your browser (localStorage) — do not require consent. Analytics cookies are only set after you accept them via our cookie banner. You can decline or withdraw your consent at any time via the banner or by clearing your browser storage, and you can block cookies entirely in your browser settings; some functions of the site may then be limited.

6. Contact form & communication (HubSpot)

When you contact us via the form on our website, the data you enter (name, email address, company, message and any optional details) is processed via HubSpot, a CRM and marketing platform of HubSpot, Inc. (USA) with its European office in Ireland. We use this data solely to process your enquiry and for follow-up communication. HubSpot may process data in the United States; transfers are safeguarded by the EU standard contractual clauses pursuant to Art. 46 GDPR. Communication by email, phone or letter is likewise recorded and retained for as long as necessary to respond or as required by law.

7. Web analytics (Google Analytics 4)

If you consent via our cookie banner, we use Google Analytics 4, a web analytics service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics 4 does not log or store full IP addresses; IP data is anonymised and used only for rough geolocation before being discarded. We use the statistics to understand how our website is used and to improve our offering. Data may be transferred to Google LLC in the USA under the EU–US Data Privacy Framework and standard contractual clauses. You can withdraw your consent at any time via the cookie banner or install the Google opt-out browser add-on.

8. Embedded videos (Vimeo)

Our website embeds videos from Vimeo, a service of Vimeo.com, Inc., 330 West 34th Street, New York, NY 10001, USA. When you play an embedded video, a direct connection to Vimeo servers is established and Vimeo receives your IP address and information about your interaction with the video, even if you do not have a Vimeo account. Vimeo may also use Google Analytics within its player. We load video players so that data is only transmitted when you actively start playback. For details, see the Vimeo privacy policy.

9. Social media links

Our website contains links to our profiles on LinkedIn, Instagram, Facebook and X. These are plain links, not embedded plugins — no data is transmitted to those platforms until you click a link. Once you visit a platform, its own privacy policy applies. We recommend logging out of social networks beforehand if you do not want your visit to be associated with your account.

10. Data security

This website uses SSL/TLS encryption for all transmissions — recognisable by "https://" and the lock symbol in your browser bar. We take appropriate technical and organisational measures to protect your data against loss, misuse and unauthorised access. Please note, however, that data transmission on the internet can never be completely secure.

11. Retention

We retain personal data only as long as necessary for the purposes described above or as required by statutory retention obligations (in particular, ten years for business and accounting records under Swiss law). Enquiry data that does not lead to a business relationship is deleted once the exchange is concluded, unless you consent to longer storage.

Within the limits of applicable law, you have the right to:

  • Request information about the personal data we hold about you;
  • Have inaccurate data corrected and, subject to statutory duties, deleted;
  • Restrict or object to processing based on legitimate interests;
  • Receive data you provided to us in a common electronic format (data portability);
  • Withdraw any consent at any time with effect for the future;
  • Lodge a complaint with the competent supervisory authority — in Switzerland, the Federal Data Protection and Information Commissioner (FDPIC).

13. Data transfers abroad

Some of the service providers named in this policy process data outside Switzerland and the EU/EEA, in particular in the United States. Where a country does not offer an adequate level of data protection, we ensure appropriate safeguards, in particular the EU standard contractual clauses, supplemented where necessary by additional measures.

We may amend this privacy policy at any time to reflect legal, technical or operational changes. The version published on this page applies. We recommend checking this page from time to time.
